Abstract

This legal writing entitled the Effectiveness of Supervision by Medicine and Food Supervisory Institution(BPOM) on the Circulation of Traditional Herbs Containing Medicine Chemical Compounds Circulated in Yogyakarta. The problem emerged was how traditional herbs containing medicine chemical compounds of which had been prohibited but still circulated and what barriers faced by Medicine and Food Supervisory Institution in the implementation of its supervisory, thus in the case of there is a fault or violation conducted by the businessmen and bring suffer to the consumers, thus this legal writing intended to comprehend the mechanism of supervision conducted of Medicine and Food Supervisory Institution(BPOM) on traditional herbs containing medicine chemical compounds and to comprehend the legal protection to the society in the case of violation towards their rights as consumers. The type of this legal research was empirical legal research. The method of analysis used in this research was analysis by comprehending and arranging sentences of which had been systematically collected, meanwhile for the reasoning process in drawing conclusion it used inductive reasoning method. The result of this research was traditional herb containing medicine chemical compounds which had been prohibited is appropriate to the Regulation of Minister of Health Number 246/Menkes/Per/V/1990 in Chapter VIII of Article 39 and Article 40 on Prohibition in Traditional Herb Industry. By reason principally traditional herb containing medicine chemical compounds results side effect that harms the consumers’ health. In addition it should be given sanction to the businessmen violating the existing regulation.
