Abstract

Marriage was a inwardly and outwardly between a man and a woman to form a family or household. Marriage is a right of every citizen of Indonesia. In forming a family or household is not only between the couple but also must be based in God Almighty, so in marriage religion is very important the validity of marriage. But in public life often some marriage that is not based on religion but with the love of the couple. Cases interfaith marriage in people’s live could be inflict a variety of problems in the terms of the law such as the validity of a marriage, because in article 2, paragraph (1) of Law No. 1 of 1974 on Marriage stating that the marriage valid if performed by each religion and article 2 paragraph 2 of Law No. 1 of 1974 on Marriage each of marriage is recorded in accordance with applicable laws and regulations. The problems discussed in this thesis is validity of marriage and registration interfaith marriage to the religion of Islam and Catholic religion in the City of Yogyakarta. The method used is a normative legal research is a research that focuses on the positive legal norms and made by reviewing the laws and regulations in force. The result showed that interfaith marriage is legitimate, because in Law No. 1 of 1974 does not regulate interfaith marriage.
