Abstract
This thesis entitled The Legal Consideration in Judges Decision against the right of the Child for Light Work (a case study of a Maumere Court Decision Number 17/PID.B/2016/PN. Mme). The purpose of this thesis is to know The Legal Consideration in Judges Decision against the right of the Child for Light Work in a Maumere Court Decision Number 17/PID.B/2016/PN. Mme. After the authors do the analysis, The Authors conclude that Judges use a negative proofment (negatief wettelijk bewisjtheorie). The negatife proofment is a proofment procedure with minimum two evidences with a Judges Confidence. The parties lodge witness testimony, professional testimony, document and defendant testimony. Based on that evidences, the judges in a case with number 17/PID.B/2016/PN. Mme, decided a unfainess decision from the child protection side as a sacrificed because the judges do not use a child protection constitution number 23 years 2003 about child protection as a Lex Spesialis Derogat Legi Generalis because the sacrificed is under 18 years old and the economic exploitation is the reason child protection principle is not exist. The judges use employee constitution number 13 years 2003.
