Abstract

Citizens right are human right guaranheed un the provisison of constitution in 1945, sector 28 A to 28 J. Besides in the constitution in 1945 also contained in law number 8 in 1981 about criminal procedur code. In the implementation process of criminal law, procedure law was required our set out in the criminal procedure of criminal procedure code. In the procedure of investigation, arrest serzup detention and police investigation had been arranged which regard the respect for human right guaranteed by the state. Criminal procedure code by the state. Criminal procedure code has been raised and set the suspect or defendant in anequal position as God’s creature who has a whole degree of human beings dignity the suspect or defendant had been placed by criminal procedure code in the position of his entity and dignity as a human being, which must be treated in accordance with the values of humanity the law has to be enforced, but in a implementions of law must consider the right which in herentel in human beings. There fore the criminal procedure code also governs about the right of suspect or defendant rights in chapter 50 to 68. With the constitution number 8 in 1981 broning flat human and suspect or defendant rights had been protected in the level of investigation. However, based on the facts, there are still the rights of suspect which have not been implemented property by the investigations in the investigation process.
