Abstract

World development on technology and business is getting faster. It is make positive impact that earn foreign exchange. In other hand, it is causing disputes due to violation of agreement conducted by one of parties. In that case, an effective alternative dispute resolution is needed to handle online activity. The purpose of this research is to examine the problem of how the arrangement of online arbitration as an alternative dispute resolution in Indonesian law system. The arrangement of online arbitration as an alternative to dispute resolution can be applied in Indonesia considering that in Law Number 30 Year 1999 is not explicitly regulated about the evidentiary power of electronic evidence used in dispute resolution through online arbitration with advantages, lacks, and procedural obstacles of online arbiration event if applied in Indonesia. Based on analysis known that online arbiration as an alternative dispute resolution is not explicitly regulated in Indonesian law system. However, it does not close the possibility that Law Number 30 year 1999 gives change for online arbiration to be done as long as not clash with existing regulations. The use of electronic evidence in dispute resolution through online arbiration also has complete evidentiary power if used in online arbiration.
