Abstract
Indonesia is A developing state based on law, have legislation that one of which is the act No. 13 of 2003 on manpower is made toregulate the connection between company and worker/laborer to guarantee rights and regulate about the obligations of parties. PT BRI (People’s Bank of Indonesia) is one of the state-owned companies in the banking sector, in running company PT.BRI also refers to the act No. 13 of 2003 on manpower, but the company’s journey received a lawsuit from a retired former employee of PT. BRI with regard to the issues of severance pay. The purpose of this research is to analyze the lawsuit by retired PT.BRI is in accordance with act No. 13of 2003. Based on above the problem this research using normative analysis study, normative is research require secondary law material as general data, as verbal or written opinion from the parties and legal experts. Based on the discussion and analysis it can be concluded that the severance lawsuit is not appropriate because based on article 167 it has been appointed that the termination of employment due to retirement is not entitled to severance pay since severance is only granted to layoff employees in general excluding layoffs due to retirement.
