Abstract

The legal writing is entitled The Authority of the Regional Representative Council on the Legislation Process in Tripartite Construction of the Regional Representative Council, the House of Representatives, and the President. The formulation of the legal matter is the implication of the Constitutional Court Decision on the authority of the Regional Representative Council in the legislation process in tripartite construction and the enhancement of the role of the Regional Representative Council in the legislation process in tripartite construction. This study aims to determine whether there are implications for the authority of the Regional Representative Council after the issuance of the decision of the Constitutional Court Number 92 / PUU-X / 2012 on the Testing of Law no. 27 of 2009 about MD3 and Law no. 12 Year 2011 about the Establishment of Legislation and to know how to increase the role of the Regional Representative Council in the legislation process in tripartite construction. This legal writing can be useful for high institutions of the state, especially the House of Representatives and Regional Representative Council in order to get input and the writing of this law is also useful for people in the regions in order to understand the functions of the Regional Representative Council . Based on the results of this law writing, it is suggested that the Regional Representative Council to continue proposing amendments to the 1945 Constitution, because the judicial review of the Constitutional Court will always be stuck with the reason of not granting part of the petitioner's petition due to Article 20 Paragraph (2) of the 1945 Constitution so that Regional Representative Council will not can ever approve a Draft Law related to Article 22D Paragraph (2) of the 1945 Constitution.
