Abstract
Post-mining activities are obligations that must be carried out by mining actors and are intended to control environmental damage as a result of mining activities. The issue in this research is how the implementation of post-mining activities as an effort to control environmental damage due to sand mining in the Lebak regency. This research is emprical legal research. Data was collected through interviews with respondents and interviewees as well as literature. As for the findings from this research are that both mining operators whose mining permits have expired or have not expired all do not make post-mining plan documents and do not place post-mining guarantees and do not carry out post mining activities. The conclusion of this research is that post-mining obligations have not been implemented due to the transition period of the transition of licensing authority in the mining sector. As for the author’s suggestion is the departement of energy and mineral resources of the Province of Banten need to do internal coordination, coordinate with other relevant agencies and need to be more serious in law enforcement against violations of post-mining activities obligations.
