Abstract

This legal writing/minithesis entitled The Legal Protection on Community Land towards Replanting in Ulu Wae Village, Poco Ranaka Subdistrict, Manggarai Regency, NTT, by legal problem is the establishment of policy of Regional Government of Manggarai Regency to disciplinize and forest supervision which is proceeded by replanting activity, without the providence of legal protection as well as without accommodate the necessity of society appropriately to the custom law and existing traditional wisdom. The replanting activity was conducted by pruning and decimation of peasants’ plants which mostly planted by productive copy plants. The purpose of this legal writing/minithesis was to study and analyze how the legal protection on the community land towards the replanting activity in Ulu Wae Village. The type of research was empirical legal research, i.e. a research focused on the behavior of legal society, wherein this research was directly conducted to the society to gain primary data as main data in addition of secondary data. Based on the result of research it can be concluded that Regional Government of Manggarai Regency did not guarantee and neither give legal protection as appropriately, as well as disregard the existence of custom legal society and custom right which has been managed hereditarily since former time.
