Abstract
Legal protection is needed for Indonesia according Act No. 62 of 1958 about the citizenship status of the children of Republic Indonesia appears to be aligned with the position of the child does not have a right to determine their own citizenship. This resulted in the existence of discrimination treatment. So that it can be said of Act 62 of 1958 no less legal protection for children. Act No. 12 of 2006 about the citizenship status of the children of Republic of Indonesia in substance and democratic than the old one of law citizenship. This is because act no 12 of 2006 to accommodate its creation has thoughts that lead to granting legal protection for children of mixed marriages. In practices, the government should guarantee that it’s easy for every citizen, specially children whom born of mixed marriages in exercising their rights and obligations as citizen of Indonesia in accordance with the applicable rules.
