Abstract

The low level of unemployment and job seekers nowdays, are enforced by a greater number of companies striving to conduct any efforts to make efficient the production cost by economizing the expenditure in expediting the human resources working in their company by outsuorcing the workers by determined period working agreement or contract worker. Unhappily, there are many companies conducting any deviation towards the fulfillment of right of the determined period workers. It is similiar to those in the implementation of determined period working agreement, the officers of security unit in Citrouli Department Store 24 Hours where in this legal research has been conducted, there are many deviation in the matters of determined period working agreement, working time and salary of which has impact to the insatiableness of the prosperity of security unit officers. The purpose of this legal research was to comprehend the cause of the implementation of determined period of the security unit officers in Citrouli Department Store 24 Hours is not in accordance to determination of regulations. The type of this research was empirical legal research. The method of analysis used was qualitative analysis, i.e. looking for any data of which is appropriate to the studied object by literary study and interview of which is directly conducted toward the respondents, i.e. security unit officers and source person is the owner of Citrouli Department Store 24 Hours. The result gained is the factors causing the happenings of these deviations are the incognizance of depart of bussinesmen of workers on the regulation ruling on the datermined period working agreement, working period, and salary, inexistence of firm verdict toward the existing violantion, and the socio-economical condition forcing the workers to receive any job although the fulfillment of their prosperity and his family is not guaranteed.
