Abstract

Legal protection is an important thing to enforce because it is a form of fulfilling rights and giving obligations. In this case legal protection must be given to victims of wrongful arrests carried out by DENSUS 88. Arrests carried out by DENSUS 88 usually often violate human rights and seem to force them to get recognition. DENSUS 88 made several arrests in Surakarta City. Therefore it is necessary to know how the legal protection for victims of wrongful arrests was carried out by Densus 88 in Surakarta City? The purpose of this study was to find out about the implementation of legal protection for victims of wrongful arrests carried out by DENSUS 88 in Surakarta City.This research was conducted with normative legal research. The results of this study are DENSUS 88 making arrests in a way that is not in accordance with human rights principles and for victims of wrongful arrest they are actually aware of the rights they have to take pretrial and sue for compensation and rehabilitation but in fact DENSUS 88 does much peace secretly to the victim was wrongly arrested by giving a sum of money, besides that the victims were too afraid of DENSUS 88 when taking the pretrial course.
