Abstract
Thesis entitled "Analysis of the Regulation of The Minister of Transportation No. 77/2011 concerning the Liability of Air Carriers to Passengers Experiencing Mental Damage due to Aircraft Accidents" analyzes the liability of air carriers for mental damage experienced by passengers by referring to the Regulation of The Minister of Transportation No. 77/2011. The problem is that the regulation regarding the liability of air carriers to passengers who experienced mental damage are not explicitly regulated in the Regulation of The Minister of Transportation No. 77/2011 and there are no fixed criteria regarding the condition of a person who can be said to be mentally damaged that led to multiple interpretations. The type of research in this thesis is a normative legal research. Normative legal research is a research to examine the implementation of positive law. The liability of the air carriers to passengers who experienced mental damage depends on the diagnosis by a doctor. If the diagnosis states that the mental damage experienced by the passengers can be cured, the compensation provided uses regulation of compensation for injuries. However, if the diagnosis states that the mental damage experienced by the passenger cannot be cured, the compensation provided uses regulation of compensation for permanent disability.
