Abstract

The Witness in criminal justice process can give the testimony to find and seek for clarity of an offence committed by an accused offender. The Law number 13 Year 2006 on Witnesses and Victims have purpose to give the legal protection for witness from threats, whether physical or psychological from certain parties. This legal research has purpose to find out the shapes of Witness legal protection and the problem in the implementation of witness legal protection in the criminal justice process. The method of this legal research used normative research which focussed on norms and supported by secondary data as main data. Source of data consisted of primary legal material and secondary legal material. The results of this legal research showed that the shapes of legal protection for witness such as according in the Article 5 clause (1) Law Number 13 Year 2006 on Witnesses and Victims Protection. The problem in implementation of witness protection in criminal justice process such as lack of the socialization about Law Number 13 Year 2006 on Witnesses and Victims Protection. Because of that, researchers want to give the recommendation about the socialization of Law Number 13 Year 2006 on Witnesses and Victims Protection must be increased.
