Abstract

Family is the smallest part in the society and also the private in social gathering inside the society. However, various kinds of crime often occur in this private part of society. One of crimes that occur is domestic violence. Woman, the one deemed to be weak side, is the victim. Woman often become the victim of domestic violence and physical violence dominates most of problems inside the household. On account of the existence of domestic violence issue, government publishes Undang-Undang Number 23 of year 2004 of Domestic Violence Exclusion. Objectives of the research are to find out the implementation of Undang-Undang Number 23 of year 2004 of Domestic Violence Exclusion in securing wife rights against physical violence crime by husband and Domestic Violence Exclusion constrains. The Method is normative law research focused on positive law norm which needs secondary data as the main data and primary data as supporting data. The main data used is the secondary data based on primary law substance, secondary law substance and tertiary law substance. The results achieved in this research are implementation of Undang-Undang of Domestic Violence Exclusion has not worked efficiently yet. It is because there are still many cases reworked by its informer. Else, patriarchy culture also blocks the successful of Undang-Undang of Domestic Violens Exclusion. Thus, active role from many sides such as police, family, society, self-supporting institute in participating in preventing and minimize domestic violence occur is expected, so that every person especially woman avoid of any kind of crime.
