Abstract
This thesis entitled “Penggunaan Tanah Pertanian untuk Usaha Rumah Makan Berdasarkan Peraturan Daerah Kabupaten Sleman Nomor 12 Tahun 2012 tentang Rencana Tata Ruang Wilayah Kabupaten Sleman” was written based on the problem formulation has the transition of the use of the farmland into nonfarmland to build restaurants in Depok Sub-district met the 2012 goverment policy number 12 about spatial planning districts Sleman. The goal of this research was to find out, to observe, and to analyse the transition of the use of the farmland into non-farmland in Depok Sub-district has met the 2012 goverment policy number 12 about spatial planning districts Sleman. This research was an empirical law research which focuses on the society’s acts. This research needs primary data as its main data beside the secondary data. The data analysis used was the qualitive data analysis in which the analysis was based on the understanding and the systematic data analysis by conducting an interview and library research. The conclusion can be made based on the data analysis by using an inductive-thinking method, that was by concluding from the specific aspects to the more general logic. From the analysis, it could be concluded that the transition of the use of the farmland into the non-farmland had not fully met the 2012 government policy number 12 about spatial planning districts Sleman. However, it met the policy in the way that the land belonged to the land kas village. It was based on the explanation of the owners of the restaurants that they had the legal license of building their restaurants on the land. The fact that the case had not met the policy was seen in the way that it used the land property rights. It was because the owners did not fully understand about the procedures and the cost of managing it. There was no rule to manage the cost of making license of the transition of the use of the farmland into the non-farmland.
