Abstract

In writing this thesis the writer investigates about the Counseling the Children as Criminals in Type 1 Balai Pemasyarakatan of Yogyakarta. The background of this research is that Balai Pemasyarakatan has duty and function of carrying out counseling process of children as criminal. The aim of the research is to describe and analyze the counseling procedure, the constraints faced, and the efforts done by Type 1 Balai Pemasyarakatan Yogyakarta in implementing counseling program to children as criminals. In writing of this thesis, the approach method applied is research of normative law in which the research type of the law is focusing on the secondary data. Research done in two ways of counseling, that is by visiting to each house (home visit) and the client comes directly to Balai Pemasyarakatan. The purpose of counseling of the children is that client will be able to realize his mistake and live naturally as a good and responsible citizen. In implementing its duty and function Balai Pemasyarakatan faced some resistances in the case of budget, facility, resistances with other law enforcer, the case of location of client residence, the case of arrangement of schedule with client and resistance in the case of giving description and job (activity equal to old fellow and client family. By considering the fact, it is required good teamwork and support from of all related parties in counseling the children as criminal in Balai Pemasyarakatan can rul well.
