Abstract

The research entitled The Implementation of the Proof-Burden Reversal Law on The Criminal Act of Corruption Case analyze about the explanation of the meaning of the proof-burden reversal on the corruption criminal act and analyze about the implementation of the proof-burden of reversal law on the court process of the corruption criminal act case in Indonesia. This research is aimed at discovering the explanation about the meaning of the proof-burden reversal on the corruption criminal act case and for discovering the implementation of proof-burden reversal law on the corruption criminal act case in the court process in Indonesia. the problem formulation of this research is (1) How is the explanation of the meaning of the proof-burden reversal law on the corruption criminal act case? (2) How is the implementation of the proof-burden reversal law on corruption criminal act case in the court process in Indonesia? The legal research is done by normative research method, which focuses on the rule legislation about corruption criminal act case and the analysis of court judgement related to the proof of the corruption criminal act. Based on the law research method, it can be concluded that the explanation of the meaning of proof-burden reversal is the limited and balance one, while from what is studied, this research discover that the proof-burden reversal is not implemented as stated in criminal act corruption law
