Abstract

Indonesia is a state of law, which places the law to regulate everything and action in the daily activities of people in Indonesia, in order to create order and prosperity in the community. Indonesia is inseparable from the flow of globalization, especially the period of social media which is a forum for people to find and provide actual information related to events that occur in society. Some cases regarding the rapid development of social media are inversely proportional to the social role of society in real terms, one of which was discussed in this study, namely people who videotaped victims of traffic accidents, without carrying out assistance to those victims. In this study, researchers will examine these facts, with a normative research method, by comparing the existing legislative aspects, with existing social facts. Indonesian criminal law has regulated the abandonment of people who need help, namely in Article 531 of the Criminal Code, but until now the implementation of the article does not exist, or law enforcement regarding the case of video recording, by law enforcement officials especially the police, no one has investigated the case, whereas the police have free action in carrying out their tasks, which is called discretion. Hopefully, this research can add insight in general to every reader, also add awareness and special information to law enforcement agencies specifically the police.
