Abstract

The purpose of this research is to know about the penal mediation in the settlement of minor theft based on the letter of National Police Chief No.Pol/B/3022/XXI/2009/SDEOPS on handling cases through ADR. This research used normative law research which is a research that focuses on norm and law base. Minor theft is one form of crime that is found in social life. Completion of the criminal act are settled through the courts by the criminal justice system are regulated by law. Along with the development of criminal law reform in many countries, nowadays there is a strong tendency to use penal mediation as an alternative settlement in the area of criminal law. Police as investigators in solving criminal cases, in principle refers to the procedure set out in the law through the courts. Discretion held by police with Restorative Justice approach allows for the completion of certain criminal through penal mediation refers to the letter of National Police Chief No.Pol/B/3022/XXI/2009/SDEOPS on handling cases through ADR. One of the criminal act which set out in the letter is minor theft.
