Abstract

The issue of liability for the conveyance of the air in Indonesia, actually have had legislation governing regarding the liability of air transportation of freight. But in fact, those liabilities often yet to be resolved. Legal accountability air transport company in air transporting via cargo does not have a clear format. This is caused by the regulations hard to be understood by companies and also public society. The liabilities issue also related to our government that could not make this legislation works well and firmly clear. For example, The legislation of the Republic of Indonesia number 1 in 2009 about the flight. Those of legislation have clearly clues, there are some underlined concerns that baggage and cargo are different things. They could not be in the same rules of things since the definition and also status are clearly different. So that, the rules how to treat liabilities of it, should be different. Hopefully this thesis could be one of sources that could make clear definitions, statements of cargo and baggage concept in air transporting service and another issue in it, like insurance. So that, in between government, air transport company and also public society could collaborate on making our legislation of air transport clearly works.
