Abstract

ABSTRAK This research is entitled The Effort of Regional Office Law and Human Rights Department to Reduce Over Capacity in Correctional Institutions within the Framework of Prisoners Development (The Study in Prison Class IIB Sleman Yogyakarta). This research based by concern of over capacity or over crowded that happened in prison. Formulation of the problem in this research is the first is, what are the factors of over capacity in prison and the second, how the effort Regional Office Law and Human Rights Department to reduce over capacity in prison within the framework of prisoners development. The kind of research used is is a type of normative law research that focuses on the norms positive law in the form of legislation. The results in research are (1) who are the causes of over capacity is the number of regulation that threatens criminal sanctions, judges who are less optimizing the conditional imprisonment and criminal prisoners who placed in a correctional institution (2) the effort Regional Office Law and Human Rights Department to reduce over capacity in prison within the framework of prisoners development especially in prisons class IIB Sleman Yogyakarta is the first, planning the new prison specifically children in Wonosari, the second by conducting the prisoners from prisons over capacity to non over capacity prisons, third by accelerating parole for qualified prisoners and the fourth to optimize the imposition of alternative criminal and criminal penalties.
