Abstract

The acquisition case of property rights from customary land often occur in indigenous communities in Papua, but not through the proper acquisition process and procedures, so that it often harms the indigenous people and even parties that acquired the property rights. The constitution of the Republic of Indonesia Number 21 Year 2001 on Special Autonomy for Papua Province explained clearly that the Government of the Papua Province obligated to recognize, respect, empower and develop the rights of the indigenous people based on the provisions of applicable law. This study aims to determine the terms and validity of the acquisition of the property rights of the individual from communal land in Hubula Tribe in the District Wouma, Jayawijaya Regency. The research conducted is a kind of normative legal research. The result of this research show that the terms and validity are obtained through deliberation, attach a letter of customary land ownership, managing the land registration at the Land Office of Jayawijaya Regency in accordance with the procedures of registration of land set by the Land Office based on Government Regulation Number 24 Year 1997 about Land Registration.
