Abstract

Indonesia is a maritime country, in which 29% of its population working as fishermen. As a state of law, every actions taken by fishermen must be based on the laws including the permit of the ship. The aim of this study was to identify the problems in overcoming ship permit, so that the results of this study can contribute to improving regulations and the welfare of fishermen. Related to ship permit for fishermen, Regulation of the Minister of Maritime Affairs and Fisheries of the Republic of Indonesia No. 11 of 2016 about minimum service standards for fishing vessel licensing outlets for re-measurement results has heen issued. The problem identified in this study was the implications of the issuance of the Minister of Maritime Affairs and Fisheries Regulation No. 11 of 2016 on fishermen in the area of West Kalimantan especially in the Penjjap Port. Method used for the research was a normative legal research. The result of this research was that the management of ship permits under 30 GT was made easier since the Ministerial Regulation Number 11 of 2016 implemented because fishermen does not need a recommendation letter in the form of Norms, Standards, Procedures and Criteria from the Ministry of Maritime Affairs and Fisheries in Jakarta. Meanwhile for fishermen or boat owners with ship capacity over 30 GT, they need to apply for their ships’ permits at the head office of the Ministry of Maritime Affairs and Fisheries in Jakarta by fulfilling all the requirements that have been set. It is expected that the management of ship permits under 30 GT is easier and does not have significant problems compared to the management of ship permits over 30 GT.
