Abstract

The title of this legal research is Forms of Legal Responsibility for Sea Cargo Expedition (EMKL) in Transporting Goods at Sea. The problem is what is the form of legal responsibility for Ship Cargo Expeditions (EMKL) in the event of default. The purpose legal research is to know the relationship and legal responsibility of EMKL as the expeditor carrying out the shipment, especially in the event of damage, loss, and delay in the process of sending and transporting goods. The Conclusion is PT Agung Irian Jaya as the EMKL or expeditor engaged in sea transportation services having the role of an intermediary who delivers the goods to the recipient. EMKL as an expediter in this matter acts as the sending party even for and on behalf of the sender's goods interests. Liability for loss of goods in the event of default can be carried out by presenting the parties, namely the sender of goods, the EMKL and the transporter of goods to be able to prove the causes of a default and if there is a proven default, the EMKL makes an official report of the goods proven to be a default. signed by the three parties namely EMKL, the sender of goods and the carrier, then submitted to the transport party to be responsible in the form of compensation for the goods sent and the total compensation by the carrier is only responsible for 10% according to the agreement and the rest is borne by the sending party.
