Abstract
In an elektronik transactions, consumer must provide their personal data to businessman because the personal data of consumer is very needed in the process of an elektronik transactions. The data is collected, stored, and sometimes analyzed for the purpose of providing economic benefic to certain businessman. As consumer provide the data to a businessman, we believe that the data will be protected and kept confidential. However, the reality is sometimes different. Laws and regulations that specifically regulate the collection, storange, publication, and protection of personal data very needed. This research is normative legal research that is prescriptive and technical. This research uses statue approach. That data that used is secondary data with the primary law material and secondary law material. Data collection technique used is deduction with the qualitative methods. In Indonesia, the regulation about personal data protection is stated in Article 26 of Law Number 11 Year 2008 on Information and Electronic Transactions and also this personal data protection regulation listed in several separate legal rules. Nevertheless, it is Article is considered general. Therefore, it is deemed necessary to be immediately ratifiend in the form of law to provide security and protection and may impose sanctions in both criminal and civil forms for those who misuse the personal data.
