Abstract

The undergraduate thesis title “Peer to peer lending Based Financial Technology Operators Provision of Data on Loan Recipients by Financial Technology Providers Related to Data Confidentiality “. Peer to Peer Lending-based financial technology is a form of financial services that finds lenders and loan recipients through a platform that becomes a facilitator created by financial technology providers. To regulate the financial services, OJK issued an OJK regulation, namely POJK Number 77 / POJK.01 / 2016 and strengthened with a copy of OJK Circular Letter Number 08 / SEOJK.03 / 2016. POJK No. 77 / POJK.01 / 2016 regulates the confidentiality of data where the organizer is required to maintain the confidentiality, integrity and availability of personal data to avoid the distribution and misuse of data on loan recipients by the lenders as well as financial technology providers. In this study the authors will discuss the obligations of the financiat technology providers to be able to maintain the confidentiality, integrity, availability of personal data. This thesis research is normative legal research. Normative legal reseacrh is a type of legal research that focuses on secondary data in the form laws and regulations taking into account legal opinions from the financial technology company. The results showed that financial technology providers must maintain the confidentiality of loan recipient data in accordance with the scope and legal relations of the parties.
