Abstract

All marriages are an engagement that binds a man and woman into husband and wife. As a result of a marriage creates a right and obligation for the parties that do it, including children from the marriage. Every legal marriage is said to be according to the law when it has been done according to their respective religion and beliefs. Apart from that, as for marriage according to custom on its own legal terms. Every marriage that has been legally carried out, then required to record it in the marriage certificate, so that it creates a certainty and legal protection for the parties involved. The purpose of this study was to determine the legal consequences of the position of his wife and children on the legality of traditional marriages according to the customary law of the Biak tribe in Manokwari District. This research found that Biak people through Biak traditional marriages in Manokwari District still do not have a marriage certificate due to the legality of their marriage only to the blessed in the church. This does not fulfill what is stipulated in the Marriage Law.
