Abstract

This legal writing entitled the review towards the impact of punishment disparity in sentence of case corruption criminal action. The problem background is while the corruption case has definite legal power, there are various differences between the sentences of the corruption case to other corruption case. From this problem background it can be formulated a case i.e. what is the basic of judge’s consideration in sentencing a criminal decision of which emerges the punishment disparity and what the impact of punishment disparity in the case of corruption. The type of the legal research, the author concluded that the judge’s consideration of which can cause punishment disparity e.g. the different of perspectives concerning on the good and bad characteristic of the accused, the existence of great number of verifying material in the trial and the existence of different of judge’s perspective concerning on the impetus caused the accused conducted the corruption. Meanwhile the impact emerged from punishment disparity can impact to the accused and society. Thus it should be created a manual of punishment sentencing towards a judged in order the judge investigates the case more objectively.
