Abstract

The ownership of apartment, is a separate individual property right with joint right over shared parts, shared object, and shared land. Then as proof of ownership of apartment units, with a certificate of apartment units. Ownership of apartment unit gives the right for the owner to use and utilize or guarantee it as a credit guarantee. Based on it, this research is intended to analysis on how the imposition of apartmen as collateral in material security. This research is a normative juridical study using qualitative analysis with secondary data sourced from primary legal material, secondary legal materials and tertiary legal materials. The data is analyzed between statutory regulations and regulations relating to the imposition of material guarantees on apartment units, the result of the research is that ownership of the apartment units can be used as a credit guarantee with a material guarantee in the form of mortgage if the proof of ownership is a certificate of ownership of the apartment unit and fiduciary security if the proof of ownership is in the form of a certificate pf ownership of the apartment building.
