Abstract

PT. Herona Express is a company engaged in the shipping service industry. PT. Herona Express in collaboration with PT. Kereta Api Indonesia (Persero) in shipping goods. Delivery of goods can be in the form of motorcycles, animals, retail goods and the price of the tariff also varies. According to Article 4 of the Law of the Republic of Indonesia Number 8 of 1999 concerning Consumer Protection which contains that the consumer is entitled to get compensation if the goods and services received are not in accordance with the agreement. In shipping goods, these three things often occur and there is often a mismatch with reality so it needs to be reviewed again the esponsibilities of the expedition namely PT. Herona Express against losses on consumer goods sent through PT. Kereta Api Indonesia (Persero). This study aims to enable the writer to know the accountability of PT. Herona Express if there are items that are late, lost and damaged when shipping goods via train. This type of research is normative legal research, namely research that focuses on positive legal norms in the form of legislation and this research requires secondary data as primary data. The form of responsibility of PT. Herona Express if there is a loss to consumers that includes goods that are not insured and goods that are insured are for goods not insured, then PT. Herona Express does not insure goods. Consumers insure their own goods, but PT. Herona Express is not bound by any insurance and PT. Kereta Api Indonesia against PT. Herona Express is in Articles 87 and 88 of Law Number 23 Year 2007 concerning Railways.
