Abstract

Environmental Impact Statement ( EIS or in Indonesian called AMDAL) which is made before an activity or business plan runs, is aimed to see the environmental impacts that may occur. The role of the community in the preparation of the EIS document is very important to provide suggestions, comments and responses at the Public Consultation stage in the AMDAL Process. There are two legal problems in this research, namely How is the implementation of the community role in the implementation of the public consultation? Secondly, what are the obstacles in the implementation at the public consultation stage in the Yogyakarta-Solo Toll EIS process? This legal research is an empirical legal research that focuses on social facts, and the data were collected through interviews and literature study. The conclusion of this research is that the Yogyakarta-Solo Toll Road public consultation has been in accordance with the Ministerial Regulation, although it is not yet optimal because of several reasons. The announcement of the EIS for the construction of the Yogyakarta-Solo Toll Road was not able to be accessed by people (especially those who potentially suffer from the project). In addition, in the implementation of public consultation required in the Ministerial Regulation such as the implementation of public consultations only village heads were invited to attend . It is therefore suggested that the announcement of the Yogyakarta-Solo Toll EIS need to be done online and there should be good cooperation between the business owner, the EIS consultant, and the community
