Abstract

“The Dayak tribal customary council has an important role in society, especially in terms of law enforcement against perpetrators of forest and land burning. The formulation of the problem in this research is how the role of the customary council of the Dayak tribe in enforcing the law against the prepetrators of forest and land burning in Kapuas hulu district. This research is an empirical legal research, data obtained through literature study and interviews with informants and respondents. The results of his research were that forest and land burning occurred in Kapuas hulu district due to clearing of agricultural and burning land, human negligence due to throwing cigarette stalks carelessly, the presence of combustible/dry fuel, the existence of fire sparks coming from others areas, and natural factors. Such as a hot dry season, resulting in dry/flammable objects friction. The conclusion is that the customary council has an important role in law enforcement against perpetrators of forest and land burning, especially for those who burn forests and land less than 2 (two) hectares. The perpetrator will be subject to sanction in the form of a warning from the customary council and compensation money for the losses suffered. His suggestion is that the Dayak tribal customary council in carrying out its duties must be stricter in imposing sanction on perpetrators of forest and land burning so that forest and land burning actors feel deterred and will not burn forest and land again”.
