Abstract

The study entitled Consideration of Judges in Deciding Defamation Cases in Writing on Social Media Related to the Implementation of Free Speech Rights analyzes the consideration of judges in considering the principle of guaranteeing the right to free speech in the verdict of defamation cases on social media. This study aims to find out whether the right to free speech is also a consideration of the judge before dropping the verdict against defamat ion committed on social media. The formulation of the problem from this research is how do judges consider the principle of guaranteeing the right to free speech, in the verdict of defamation cases on social media? Legal research is carried out using normative research methods that use legislation on the consideration of judges in deciding cases, criminal defamation through electronic media and guarantees of free speech rights in Indonesia, as well as analysis of court decisions regarding the consideration of judges in the guarantee of free speech rights before dropping a verdict on criminal defamation on social media. Based on the method of legal research it can be concluded that the judge does not include and relate the principle of the right to free speech in the consideration of the verdict, but in the judges consideration incorporates the values of justice, usefulness, and morals as the fulfillment of a sense of justice for the community when going to deliver a verdict.
