Abstract

Legal Writing entitled Legal Consequences of The Decision of The Contitutional Court No. 18/PUU-XVII/2019 to billing services providers in execution of fiduciary collateral objects. The decision of the constitutional court No. 18/PUU-XVII/2019 is a decision that has an impact on Article 15 paragraph (2) and paragraph (3) of Law Number 42 of 1999 concerning Fiduciary Guarantee. In Indonesia, many finance companies use billing service provider services to execute the fiduciary collateral object, with the decision of the constitutional court No. 18/PUU-XVII/2019, how is the legal consequences of the decision of the Contitutional Court No. 18/PUU-XVII/2019 for billing services providers in collecting debtors? Based on the result of the study using normative research method, data showed that debtor usualy use billing service provider to execute fiduciary collateral objects using a power of attorney from debtor, so the billing service provider can execute the fiduciary collateral object, before and after the decision of the constitutional court No. 18/PUU-XVII/2019 billing service provider can excute the fiduciary collateral object as long as the debtor can use hit executorial rights and provide a power of attorney, so the decision of the constitutional court No. 18/PUU-XVII/2019 has indirect consequences for billing services providers.
