Abstract
Fanfiction novels in Indonesia use artist portraits as book covers without permission, which contradicts Article 12 of the Copyright Act which requires everyone who wants to use a portrait to ask permission first by the person being photographed. This thesis aims to analyze the legal position of the artist as the party whose photos are used in fanfiction works and to analyze fanfiction works that obtain copyright protection. The legal research method used is normative legal research. The result of his research is the legal standing of the artist as the party whose picture is used in the fanfiction story as the holder of the right to a portrait so that he has the right to give permission or not to other parties who want to use his portrait. Fanfiction can get copyright protection if it is original and the author includes a disclaimer.
