Abstract

Parental marriage determines the status of the child born. Children born not in legal marriages or out of wedlock resulting children having the status of illegitimate children. Many children outside of marriage become victims of abortion, neglected by their parents, become victims of violence, and etc. Illegitimate child are very vulnerable to not fulfilling their rights as children. The future of the nation is in the hands of its future generations, therefore to obtain a quality next generation requires the fulfillment of good children's rights. This research uses empirical method. This study explains the protection of the civil rights of illegitimate child by the Asrama Karya Tasih of the Gembala Baik Foundation in Bantul Regency. The civil rights of children that are discussed include the child's right to life, the right to an identity, and the right to know and be cared for by parents. The conclusions of this study found that the protection of the civil rights of children outside of marriage by the Asrama Karya Tasih of the Gembala Baik Foundation in Bantul Regency has been going well and is in accordance with the prevailing laws and regulations, although in some cases the implementation of the rights of the children is late. This research suggests that the public and government, in this case the service related to child protection, and the population and civil registration service, can improve education to eliminate discrimination against illegitimate child and their mothers, and suggest that Asrama Karya Tasih can better monitor the fulfillment of rights an illegitimate child outside the Yogyakarta area who was part of the program participants at the Asrama Karya Tasih.
