Abstract

This Legal Memorandum discusses the fulfillment of compensation rights for workers affected by layoffs due to the Covid-19 pandemic. This writing aims to determine the compensation for termination of employment that must be paid by PT. Chocolate Nusantara in fulfilling the rights of workers / laborers who were terminated from work during the Covid-19 pandemic and whether the legal steps to file a lawsuit at the Sleman District Court that will be taken by workers / laborers after the mediation process have found no bright spots. This writing uses the normative legal research method, which focuses on positive legal norms in the form of statutory regulations and uses primary and secondary legal materials. The data collection technique used is literature study and will be studied using Inductive logic. In this case, workers are entitled to compensation for termination of employment and legal protection based on Law Number 13 of 2003 concerning Employment, Law Number 11 of 2020 concerning Job Creation, Government Regulation Number 35 of 2021 concerning Specific Time Work Agreements. , Transfer, Working Time and Rest Time, and Termination of Employment. So that the recommendation from the author is compensation for termination of employment that must be provided by PT. Chocolate Nusantara is each according to the length of service of a worker / laborer for reasons of efficiency, as stipulated in the provisions of Article 43 paragraph (1) of Government Regulation Number 35 of 2021 concerning Specific Time Work Agreements, Transfer, Working Time and Rest Time, and Termination of Employment, so that if the fulfillment is not carried out by PT. Coklat Nusantara, workers / laborers affected by termination of employment with PT. Chocolate Nusantara, a bipartite process can be carried out then mediation with a conciliation or arbitration process, if the process is not clear, workers / labor can file a lawsuit at the Industrial Relations Court.
