Abstract

The environmental damage caused by the industrial activities that produce waste from hazardous materials is not going well managed and nor regulated. Therefore, there is a need for supervision from the environmental government service of Balikpapan, as well as other law enforcement in controlling an operation that produces hazardous materials waste to bring in accordance with appropriate standard procedures and rules of law in order to avoid the environment pollution such as at Balikpapan city. This research aims to analyze and examine the law enforcement against carbide residue waste management violations and the role of environmental government services playiin supervising hazardous materials waste management of carbide residue in Balikpapan. This research is based on empirical legal research methods. The types of data used are primary and secondary data. The results showed that law enforcement by the environmental government services and Police Department in Balikpapan have played a effective role both in the administrative law enforcement and criminal law enforcement. However, it is not likely that there are some weakness such as administration penalties, which are found to be less burdensome for the offenders of B3 waste management abuses. Those who disobey should be given other administrative penalties such as government compulsion, coagulation environmental permits or the elimination of environmental permits and thus have a chary effect.
