Abstract

Sexual harassment is a form of sexual violence that often occurs in people's lives. In the household there are also many acts of sexual harassment, where the house should be a safe place for someone to take refuge. Reported in the CATAHU 2019 publication of Komnas Perempuan, there were 2,807 cases of sexual violence in the household scope. The purpose of this study is to analyze court decisions related to sexual harassment in victimology study households by looking at judges' considerations in providing protection for victims. In making a decision, the panel of judges takes into account both juridical and non-juridical considerations. In their juridical considerations, the judge looks for the elements of the article that is being charged against the defendant, while in his non-juridical considerations, the panel of judges looks at the facts at trial relating to alleviating circumstances and burdensome circumstances. Based on this research, a victim experiences some suffering physically, psychologically, mentally and even economically, in which this suffering will interfere with the victim's life. With the existence of a court decision, it does not fully provide protection for victims. Because basically, sexual harassment is an incident that can traumatize the victim. Based on these results, by only criminalizing or suing for divorce, the victim still has not made himself recover from the suffering he experienced.
