Abstract

This legal research analyzes the determination of the floating net cage business zone as an effort to prevent the pollution of the waters of Lake Toba in the Humbang Hasundutan Regency and its application by the floating net cage business actors. This research is a descriptive empirical legal research type with a qualitative approach. This research data includes primary data and secondary data. Sources of data used include primary legal materials, secondary legal materials and tertiary legal materials. Data collection techniques are carried out by field studies and literature studies. Based on the research and data analysis that has been carried out, it can be concluded that the zoning of the floating net cages in the waters of Lake Toba in Humbang Hasundutan Regency in the context of preventing environmental pollution has not been implemented in accordance with the applicable provisions, namely Presidential Regulation Number 81 of 2014 concerning Spatial Planning Lake Toba area and its surroundings. This is due to the fact that the Provincial Government has not ratified the official rules for zoning for floating net cages in Humbang Hasundutan district, thus to fill the void, the district government issued a policy to establish a floating net cage business zone in Tipang Village, Baktiraja District. However, this policy is also not in accordance with Presidential Regulation Number 81 of 2014 concerning the Spatial Plan for the Lake Toba Area and its Surroundings.
