Abstract
To create a professional police institution, our society demanded a separation between the State Police of the Republic of Indonesia and the Indonesian Army. With this separation the police is no longer subject to the Military Court but to the General Court. Besides the, the police institution also carries out the discipline assembly and the ethic code assembly. Nowadays, there is no special regulation which arranges the court preferred if the police acts against the law, where an such an offence is under the authority of those three assemblies. Therefore we need a certain law for the police corps members who act against the ethic code assembly or commit an offence. This descriptive research aims at describing which assembly must be preferred if there occur some cases and applying principles of the procedure law in the assemblies of ethic code commission. The research result indicated that the assembly of ethic code commission does not belong to the practice of judicial power, so that assembly of ethic code examination which goes a long with criminal act that is committed by a police a member is conducted in General Court and when it has been sentenced the judge and has had a binding force, it will be continued by the assembly in to Court Ethic Code Commission. To achieve law certainty, the order and law related to the establishment of law and police institution should be formulated obviously and should be contaminated by other interest.
