Abstract

The The title of this research is The Responsibility of A Seller to The Consumer of Whitening Cosmetics That Contain Mercury. This study aims to provide benefits for the development of science and the advancement of science, especially in the field of consumer protection regarding the responsibility of sellers to consumers who use facial whitening cosmetics that contain mercury. The formulation of the problem of this study is : what is the responsibility of a seller to the consumer of whitenig cosmetics that contain mercury? The research data was collected by using normative legal research methods, which focuses on legal norms consisting of primary and secondary data also through interviews with seller and consumers. The analysis carried out was taken based on Law No.8 of 1999 about Consumer Protector as well as a direct approach to the parties concerned. The conclusionof this research is the writer found that the facts were inconsistent with statuory regulations. Based on interview with consumer, the seller refused to give compensation and was still selling Temulawak and HN creams that were clearly registered as containing mercury at the BPOM. In this ccase, the seller does not fulfill his obligation and responsibilities which are clearly regulated in Article 8 Paragraph (1) and Article 19 of Law No.8 of 1999 about Consumer Protection, as well violating Article 4 of Law No.8 of 1999 concerning consumer Rights.
