Abstract

From various events that happen, the process of implementing law enforcement is actually the main study examined in this research especially Domestic Violence (intimate partner violence) cases which are often done by adults and children. What kind of legal rules that can be used to provide law protection for women who are the victims of domestic violence? Aims to find out and analyze legal rules that can be used as a basis to provide legal protection for women who are the victims of domestic violence. This research is normative legal research that identifies law protection for women who are the victims of domestic violence. This research used secondary data consisting of primary legal resources, secondary legal resources and tertiary legal resources. The data obtained from all resources were then discussed and concluded. The conclusion is that legal rules that can be used to provide law protection for women who are the victims of domestic violence are classified based on the victims’ age. If they are under 18 years old, they will be subject to Law Number 35 Year 2014 regarding Child Protection. Meanwhile, if they are over 18 years old, Indonesian Criminal Code will be used. A child who is a offender may be subject to punitive and corrective sanctions according to the Law of Criminal Justice System of Children. If she / he is over 18 years old, then the punitive sanctions are applied in accordance with the criminal acts she/he has committed. The researcher suggest that the law enforcer have to be more careful in analyzing legal protection for women who are the victims of domestic violence.
