Abstract

Victims protection of crime in national legal systems seem to have not received serious attention. This can be seen from at least the rights of crime victims to obtain the setting of national legislation. One form of protection for victims of crime and the rights of victims of a crime is to get compensation. Compensation awarded by the State to victims of gross human rights violations. Decision compensation above the normative which impeded the implementation of execution verdict can only be implemented after a court decision that is permanent. Objectives to be achieved in this study was to determine the compensation arrangements for victims of human rights violations based on the Act - Act No. 13 of 2006 on Protection of Witnesses and Victims. This type of research used the normative legal research. Normative legal research necessary to find a normative, "What compensation arrangements for victims of gross human rights violations based on Law No. 13 of 2006 on Protection of Witnesses and Victims." The rights of victims of human rights violations is already regulated in Law Number 13 Year 2006 on the Protection of Witnesses and Victims, but since the enactment of Law No. 13 of 2006 not one victim of human rights violations that weight gain compensation. It is not in accordance with the Basic Principles and Guidelines for the Recovery of Victims Rights Violations International Human Rights Law and Humanitarian Law and the Declaration of Basic Principles of Justice for Victims of Crime and Abuse of Power in which stated that every victim of Serious Violations of Human Rights entitled to compensation given by the State, then it ought Act No. 13 of 2006 on Protection of Witnesses and Victims repairs / revisions to the rights of victims are already regulated in Law No. 13 of 2006 in accordance with the principles of international law.
