Abstract

Hospital is a health service institution that provides individual health services completely that provides inpatient, outpatient and emergency services. Hospitals are very important, so they must continue to improve the quality of service to make it easier access and protection of patient safety. The establishment of hospital requires a permit from the competent authorities, in the case is the government. Permission is considered as a governement instrument. Government instrument is used by the government or state administration in carrying out its duties. This paper analyzed the synchronization of Regulation of the Minister of Health Number 3 of 2020 Against Government Regulation Number 24 of 2018 in terms of accelerating licensing services. This paper uses normative legal approach. Based on the research conducted, the author concluded that there is an asynchronism between Regulation of the Minister of Health Number 3 of 2020 with Government Regulation Number 24 of 2018. The asynchronism was found in fulfilling the commitmens for building and operational permits. The consequence of this asynchrony is the contradiction between lower regulation and higher regulations. This causes the lex superior derogate legi inferiori principle to be applied.
