Abstract

The object of study in this research is about the causal factors and legal aid efforts for members of the Indonesian Army who commit werving abuse which is a criminal act. Because the abuse of werving is a deliberate act because as formulated and threatened with punishment in the criminal legislation. The purpose of this study is to find out the criminogenic factors that cause werving abuse, Bankum's obstacles in handling cases of werving abuse, besides that it also finds out legal aid efforts for members of the Indonesian Army who commit werving abuse. The research method used in this study is the sociological juridical method, so that the data obtained is data that describes the factors that cause werving abuse, Bankum constraints and legal aid efforts for the Indonesian Army who commit werving abuse. Based on the research, it was found that the criminogenic factors causing werving abuse that occurred in the Indonesian Army were: those from the perpetrator, and the mental factor of the perpetrator who did not understand and realize that he was a TNI-AD soldier, and the lack of understanding of religion and besides that also economic problems resulting from consumptive life.
