Abstract

The guarantee of legal certainty in the land sector, first of all, requires the availability of written, complete and clear legal instruments that are carried out consistently in accordance with the spirit and content of the provisions. Therefore, the purpose of this research is to find out and describe the legal certainty of holders of land ownership rights by religious institutions, especially the MSC Congregation in their religious and social activities. This research is a kind of normative-qualitative study. The data used is secondary data through literature study in the form of laws and regulations and in the form of several legal opinions in doctrine related to the legal certainty of land rights holders by religious institutions. In the end, a conclusion was found as an answer to the problem regarding legal certainty and at the same time providing correct understanding and reasoning for religious institutions regarding the subject as holders of property rights over land as well as focusing on justice and legal protection in social and religious activities as well as for other related parties.
