Abstract

The development of today's society there is a agreement form which is usually called arisan and is done online. The Mamsha Online Arisan Community has run an online arisan, but its position is still constrained by law, because the contracts made include qualifications for borrowing and buying or selling contracts in electronic form or certain legal entities. From these problems, several questions arise whether the online arisan conducted by the Mamsha Community can be qualified as a valid Electronic Contract? and how are the liabilities and disputes between owners and members in the Arisan Online Mamsha Community? After conducting legal research with an empirical approach, it can be said that the online arisan organized by the Mamsha Online Arisan Community can be qualified as a valid electronic contract, because it fulfills the requirements of an electronic contract. The owner's liabilities give credit to get social gathering and the right receive member deposits. The member's liabilities is to return the arisan credit with a total deposit of the same value as the one lent and the right to receive a loan in the form of arisan money. Dispute resolution through negotiation, mediation and filing a lawsuit in court.
