Abstract

Bank Indonesia issued Indonesian bank regulations Number 18/40/PBI/2016 concerning the Implementation of Payment Transaction Processing which in the Elucidation of Article 34 of this Indonesian bank regulations raises legal issues in the form of legality of using ava tokens as payment instrument in Indonesia. The formulation of the problem raised is how is the legality of using Ava Token as payment instrument on the Travala.com website in the Unitary State of the Republic of Indonesia?. The author uses normative juridical law research methods. the result of this research is that The ava token is classified as a virtual currency that is prohibited from being used as payment instrument in accordance with article 34 of the Indonesian bank regulations and does not require the principle of legality because it has a legal basis and is reinforced by the principle of lex specialis derogate legi generali as seen in Bank Indonesia Regulation Number 17/3/PBI/2015 concerning the Obligation to Use Rupiah in the Territory of the Unitary State of the Republic of Indonesia. based on the application of the above methods and principles, the ava token has no legality to be used as a means of payment on the travala.com website in Indonesia.
